Welcome to TREKS (operated via treks.events, referred to as “we”, “us”, or “our”). These Terms of Service (“Terms”) govern your access to and use of our website, event booking systems, educational and corporate programs (including the STEAM Series, Corporate ESG/Wellness retreats, and BioScape-integrated experiences), and mobile digital trail tools.
By accessing our website, submitting an inquiry, or booking an experience with us, you agree to be bound by these Terms.
1. Services & Program Scope
Experiential Programs:
TREKS coordinates, designs, and facilitates experiential outdoor education, corporate retreats, and community trail initiatives at designated partner destinations (such as Awana Genting and Avillion Port Dickson).Digital Tools:
In conjunction with our events, participants may interact with mobile web apps or progressive web platforms (such as the BioScape App) for wayfinding, species identification, and gamified challenges.Advisory Role:
TREKS provides training, facilitation, and trail curation. Hospitality services—including room stays, catering, and resort-level amenities—are supplied under the direct operational responsibility of partner venues.2. Booking, Quotations & Confirmation
Inquiries & Briefings:
Program options selected via online forms or 20-minute discovery briefings do not constitute a confirmed reservation until formal agreements or official purchase orders/invoices are executed.Corporate Training & HRD Corp:
Where corporate programs are marked as HRD Corp claimable, employers and organizing entities are solely responsible for timely grant applications and internal approvals in accordance with current HRD Corp regulatory guidelines.School & Youth Expeditions:
Bookings on behalf of educational institutions require authorized administrative or principal endorsement, with full disclosure of participant counts, age bands, and relevant chaperone commitments prior to program lock-in.3. Safety, Participant Conduct & Assumption of Risk
Outdoor Nature Setting:
While TREKS programs prioritize safety through flat paths, supervised trails, and risk assessments, outdoor programs naturally carry ambient environmental factors (weather changes, natural uneven ground, insects).Supervision:
For school programs (such as STEAM Junior Explorers and Young Pioneers), teachers and designated school chaperones retain supervisory responsibility over student conduct and personal safety alongside our on-site facilitators.Compliance with Instructions:
All participants must adhere strictly to the safety guidelines, marked pathways, and instructions issued by TREKS lead naturalists and venue safety teams. TREKS reserves the right to remove any participant whose conduct threatens group safety.4. Inclement Weather & Itinerary Adjustments
Safety First:
Outdoor segments are subject to weather adjustments. If sudden rain, lightning risk, or poor outdoor conditions arise, field modules transition into shaded pavilions or indoor interactive living labs.Non-Refundable Weather Disruptions:
Weather adaptations executed to safeguard participants do not qualify for full or partial event cancellations or refunds.5. Intellectual Property
All curriculum designs, training frameworks, BioQuest digital formats, mobile user interfaces, visual assets, text, and educational methodologies displayed on treks.events are the proprietary intellectual property of TREKS and its licensors.
Users and clients are prohibited from reproducing, reverse-engineering, or repurposing our proprietary program blueprints for commercial resale without prior written authorization.
6. Limitation of Liability
To the maximum extent permitted by Malaysian law, TREKS, its directors, employees, and event partners shall not be held liable for personal injury, property loss, or incidental damages arising out of natural risks during outdoor sessions, except where caused directly by gross negligence on our part.
7. Governing Law
These Terms are governed by and construed in accordance with the laws of Malaysia. Any dispute arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the Malaysian courts.
